CRISNY Subscriber Agreement

In consideration for use of CRISNY, and the efforts of the CRISNY organization and Board of Directors, the undersigned hereby agrees to the following:

  1. That he/she is at least [18] years of age, or that this agreement is subscribed by a parent or guardian over [18] years of age.
  2. To abide by all the rules, regulations, and guidelines adopted by the Board of Directors.
  3. That use of CRISNY is a privilege which may be suspended or revoked by the Directors, upon due cause shown and an opportunity to be heard.
  4. To use CRISNY in a legal, responsible and efficient manner, and to refrain from the use of obscene, unlawful, or abusive language or material.
  5. That the CRISNY Board of Directors and/or its staff shall have the right to monitor, review, and remove any material stored in files to which all subscribers have access, for the purpose of enforcing this agreement and assuring compliance with it.
  6. To comply with all laws relating to copyright, patents, trademarks, and other intellectual and proprietary right, whether in the form of software, text, or digital information; all laws relating to libel, slander, harassment, and personal privacy protection, whether federal, state, or local and whether statutory or common-law rule, and that such compliance is the responsibility of the individual subscriber and not of CRISNY.
  7. That the subscriber shall indemnify and hold harmless CRISNY, its directors, agents, officers, volunteers, and staff, or any of them, from liability for any injuries or damages suffered by the subscriber, to the extent such liability is due to the actions of any individual subscriber or group of subscribers.
  8. That the information on the system is offered as a community service and is not intended to be, and is not a substitute for, professional consultation.
  9. That each subscriber is responsible for the security of his/her own user ID number and password, and that CRISNY is not responsible for unauthorized use of the account of any subscriber no matter what the cause of such misuse.
  10. That the subscriber shall not undertake any activities or use any software or devices which does or might have the effect of degrading or disrupting system performance, or of otherwise defeating the purpose of providing a free, full, and efficient flow of information.
  11. That statements or uses which are not consistent with the goals of CRISNY set forth in the Statement of Purpose and any User Guidelines published by CRISNY, can be reported by any subscriber by using the CRISNY Feedback utility.
  12. That CRISNY does not warrant the network to be error- free, and is not liable for claims due to loss of information or files due to network error. In no event will CRISNY be liable for any damages resulting from loss of data or use, including lost profits, incidental or consequential damages, or due to any system malfunction or failure.
  13. That the subscriber shall not, through the use of the CRISNY system, engage in any act of fraud or misrepresentation, or use any device, scheme, or information for the purpose of obtaining anything of value through false pretenses, or otherwise use the CRISNY system to violate any laws of the United States, or the State of New York.
